Information on how to enter the Promotion forms part of these Terms and Conditions. Customers who participate in this promotion (Participants) agree to these Terms and Conditions.
If the Participant does seek to participate in any Promotion, then the Participant will be treated as having accepted these Terms and Conditions.
The Promotion
1. The Promoter is STANLEY BLACK & DECKER AUSTRALIA PTY LTD ABN 82 000 021 938 (“Promoter”) of 810 Whitehorse Road, Box Hill, VIC 3128 AUSTRALIA.
2. To be eligible to claim, individuals must purchase any Eligible Product(s) to the amount of $220 or more OR $320 or more (as further set out below) from participating Mitre 10, Home Hardware, Thrifty Link Hardware or True Value Hardware stores during the Promotion Period and in one transaction (Qualifying Purchase).
3. Making a Qualifying Purchase during the Promotional Period (defined below) and in accordance with these Terms and Conditions may enable a Participant to be eligible to claim the BONUS (BONUS) from the selection below, depending on the Participant’s Spend Level. Only one of the two options outlined below can be achieved per transaction. The BONUS items form part of one of two STANLEY Tool Packs, dictated by the total spend per transaction, and are described as the products listed against Tool Pack 1 or Tool Pack 2 in the table below

Promotional Period
4. The Promotion commences at 8:00 am AEST on 27th MAY 2026 and closes at 11:59 pm AEST on 30th JUNE 2026 (“Promotional Period”). Entries for the Promotion relating to purchases made during the Promotional Period will be accepted online until 11:59pm AEST on 14th JULY 2026.
Eligibility of Participants
5. Participation in the Promotion is restricted to Participants that at the time of submitting their Online Redemption Form:
a) are Australian residents; and
b) are aged 18 years or over.
6. Business, company, and trade purchasers are not entitled to participate in the Promotion.
7. The Promotion is not available in conjunction with commercial tenders or bulk orders. Resellers are not eligible to claim on behalf of 3rd party customers.
8. Employees (and their immediate families) of the Promoter, resellers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or cousins.
Eligible Products
9. Individuals must purchase qualifying STANLEY products from participating Mitre 10, Home Hardware, Thrifty Link Hardware or True Value Hardware stores during the Promotion Period (Qualifying Purchase) to redeem one of two BONUS STANLEY Tool Packs, determined by the total spend of STANLEY products per transaction. Qualifying products are determined as all STANLEY and STANLEY FATMAX branded items, including Power Tools, Outdoor Power Equipment, Hand Tools, Lasers, Storage and Accessories. Licensed products under the STANLEY & STANLEY FATMAX brand are excluded and will not be accepted in the transaction spend levels.
How to claim
10. To be eligible to participate in the Promotion and claim a Bonus, a Participant must, during the Promotional Period:
a) Make a Qualifying Purchase(s) from a participating Mitre 10, Home Hardware, Thrifty Link Hardware or True Value Hardware store (On-line purchases are eligible).
b) Ensure that the Spend Level is met in One Transaction/Receipt.
c) Visit the Promoter’s website: www.stanleypromotions.com.au (Website) and fully complete the online redemption form including provide all requested information (Online Redemption Form); and
d) Agree to these Terms and Conditions.
11. The Eligible Product(s) must be purchased for personal use only. Commercial transactions are not included in this Promotion.
12. Participants must be in possession of the Eligible Products for each Qualifying Purchase. If any Eligible Products are returned or exchanged after the submission of the Online Redemption Form by the Participant, the Promoter may, in its absolute discretion:
a) Reject the Online Redemption Form; and/or
b) Refuse to dispatch any redemption; and/or
c) Disqualify the Participant from participating in the Promotion; and/or
d) If the redemption has been dispatched, demand payment of recommended retail price of the redemption Bonus from the Participant.
Identity of Participant
13. The name of the Participant submitted in the Online Redemption Form must match the name on the purchase receipt or the credit/debit card that purchased the Qualifying Purchase(s). If there is a discrepancy between the identity of the purchaser, the name on the credit/debit card, and/or the name of the Participant noted on the Online Redemption Form, the claim submitted by the Online Redemption Form will be deemed invalid and is incapable of being resubmitted to the Promoter.
14. The Promoter may require entrants to provide these and/or information regarding the circumstances of Eligible Product purchases to the Promoter or its agent as part of the claim verification process. Failure to provide these to the Promoter’s satisfaction will result in an invalid claim (and, at the Promoter’s discretion, in all of the Participant’s claims being invalid).
Proof of purchase
15. To verify each claim, Participants must retain the original purchase receipt(s). Proof of purchase is a strict condition / requirement for redemption. The Promoter may request the Participant provide the original purchase receipt. Failure to produce the original proof of purchase will invalidate the claim made by the Participant in the Online Redemption Form.
16. If a Participant is unable to provide proof of purchase for all entries, then all the entries of that Participant will be deemed invalid. Sharing receipt / invoice numbers is not allowed. If the Promoter reasonably believes that an entry has been made on this basis, the Promoter will invalidate all entries affected.
Maximum number of claims
17. Multiple claims are permitted subject to: (a) a maximum of one (1) claim per Qualifying Purchase regardless of the amounts spent in the Qualifying Purchase(s); and (b) a maximum of three separate (3) claims per Participant during the Promotional Period.
18. Claims must be submitted separately through the Website.
19. If more than two redemptions are sought using the same purchase receipts, the Promoter, in its absolute discretion will determine which Online Redemption Form(s) it will reject.
All claims to be submitted during the Promotional Period
20. All claims made by a Participant under the Promotion must be made by the Participant by the close of the Promotional Period. No extensions of time will be granted
Promoter’s right to investigate
21. The Promoter reserves the right to investigate any information contained in the Online Redemption Form and to request further information from the Participant in support of the Participant’s participation in the Promotion.
22. The Promoter may request further information from the Participant such as the Participant’s proof of address, name, age, occupation, employer, bank/credit card statements and any other information the Promoter may reasonably require in order to validate a claim.
23. Failure by the Participant to provide any information requested by the Promoter may, in the Promoter’s sole discretion, result in the Online Redemption Form being invalid.
24. Any discrepancies in the information contained in the Online Redemption Form and the information provided by the Participant to the Promoter will result in the Online Redemption Form being invalid.
25. Incomplete Online Redemption Forms or failure to provide information requested by the Promoter will result in the Online Redemption Form being invalid.
26. The Participant consents to the Promoter contacting the Participant by email and telephone to discuss the Promotion.
Acceptance of claims sought by Online Redemption Form.
27. Once the Promoter has validated all information provided by the Participant, if the claim is approved, the Participant will receive an email confirming:
a) acceptance of the Online Redemption Form; and
b) the Bonus that will be sent to the Participant.
28. The Promoter will make all reasonable attempts to provide the Bonus nominated in the Online Redemption Form to the Participant, but if the Bonus is unavailable for any reason, the Promoter reserves the right to substitute a similar Bonus that is equal in price and/or performance.
29. Participants will not be entitled to any additional compensation in the event that the Bonus has been substituted.
30. The Promoters decision to accept or decline an Online Redemption Form is final.
Participant to act in good faith at all times
31. The Participant agrees that it will act honestly and in good faith at all times.
32. If the Promoter believes that the Participant has been dishonest, tampered with the Promotion and/or the claims process, has engaged in unlawful or fraudulent conduct or breached these Terms and Conditions, the Promoter may disqualify the Participant from participating in the Promotion or reject any and all Online Redemption Forms submitted by the Participant.
Online entries only
33. Entries may only be submitted online and in the form set out at the Website and may not be accepted by the Promoter in any other form. If the Participant is unable to submit its Online Redemption Form using the Website, the Promoter may, in its discretion, allow an alternative means for the Online Redemption Form to be lodged with the Promoter. The deadlines and other Terms and Conditions continue to apply in such circumstances.
No liability for lost, late or incomplete Online Redemption Forms
34. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
35. The Promoter has no control over mobile telephone or internet communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
Delivery
36. Delivery may take up to 45 working days from receipt of entry and will be by ordinary post.
37. The Promoter is not responsible for any delay or damage to the Bonus that occurs during delivery.
38. The Promoter is not responsible for any incorrect or incomplete addresses provided by the Participant in the Online Redemption Form.
Use of personal information
39. The Promoter may, for an indefinite period, unless otherwise advised, use the information submitted by a Participant for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Participant and/or its authorised representative. Participants should direct any request to opt out, access, update, or correct information to the Promoter at auredemptions@sbdinc.com
40. The Promoter collects personal information of the Participants in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and Bonus suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.stanleyblackanddecker.com/privacy-policy
Limitation of Liability
41. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia that are incapable of being excluded (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
42. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
a. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b. any theft, unauthorised access or third party interference;
c. any Online Redemption Form that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d. any tax liability incurred by the Participant; or
e. use/taking of a Bonus.
Other matters
43. The Promotion is only valid for those residing in mainland Australia (including Tasmania and other major offshore islands). The Promoter reserves the right to withhold delivery of the Bonus if the delivery address of the Participant falls outside of these locations.
44. The Promotion cannot be used in conjunction with any other offer.
45. The Promoter reserves its right to modify suspend, terminate or cancel the Promotion in circumstance where the Promotion is unable to continue due to reasons beyond the control of the Promoter including but not limited to war, pandemic, ongoing supply chain issues.
46. Bonuses are not transferable or exchangeable and cannot be taken as cash.

Instructions on how to claim and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.

To claim, individuals must then visit https://www.mitre10.com.au/makita-mania or https://www.homehardware.com.au/makita-mania (depending on where the Qualifying Spend was made), follow the prompts to the promotion claim page, upload their purchase receipt, input the requested details including full name, phone number and valid email address and submit the fully completed claim form during the Claim Period. Upon validation of each claim, the prize will be sent by email to the claimant’s email address as indicated on their claim form. Claims submitted online in accordance with these Terms and Conditions will receive either a Mitre 10 or a Home Hardware e-Gift Card/s (depending on where their Qualifying Spend was made). Incomplete or indecipherable claims will be deemed invalid.
Claimants must retain their original tax invoice(s) for all claims as proof of purchase. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of a claimant’s claims and forfeiture of any right to a prize. Tax invoice(s) must clearly specify the store of purchase and that the purchase was made during the Purchase Period but prior to claim.
If a Makita product(s) purchased as the basis for a prize(s) under this Promotion is returned for any reason other than pursuant to Australian Consumer Law or a manufacturer’s warranty, the applicable prize(s) must be returned or recompensed to the Promoter.
If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
The Promoter’s decision is final, and no correspondence will be entered into.
e-Gift Card/s are subject to the standard terms and conditions as applicable. e-Gift Card/s can be used online or in store.

How to enter |
In store and online. To be eligible to enter and be eligible to win, entrants must, during the Promotion Period, purchase two (2) litres or more of any Dulux branded paint product (each an “Eligible Product”) in a single transaction from a Participating Store or via the participating stores Online platform (Qualifying Purchase). To receive an automatic entry into the Promotion an Eligible Entrant must complete the following steps during the promotional period: Purchase two (2) litres or more of any Dulux branded paint product in a single transaction at a Participating Store and scan their Mighty Rewards (Mitre 10) or DIY Rewards (Home Hardware) Card upon payment (“Qualifying In-Store Transaction”). The “Major Prize” in the Major Draw will be awarded to the first valid entry drawn, and will comprise of One Million (1,000,000) Mighty Rewards or DIY Rewards Points, applied to the Mighty Rewards or DIY Rewards member account used on entry and valued at AU$10,000.00 (ten thousand dollars AUD). Mighty Rewards and DIY Rewards Points are redeemable at participating Mitre 10 and Home Hardware stores or online at Mitre10.com.au or homeware.com.au. The first valid entry randomly drawn from all valid entries received up to the time of the relevant draw will win the Major Prize. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Prize Redemption |
Mighty Rewards points and DIY Rewards points must be redeemed within twelve (12) months from the date of issue and will automatically expire at this time on the winner’s member account. It is the responsibility of the prize winners to ensure the prize is redeemed in full. Any ancillary costs associated with redeeming any Rewards Points are not included. Any unused balance of the Rewards Points won will not be awarded as cash. If any part of the prize or the Rewards Points are redeemed in a transaction which is subsequently refunded, the prize winner will forfeit any Rewards Points used within this transaction. The Rewards Points credited to the winner’s accounts are subject to the prevailing terms of the relevant rewards program. |

The Rewards Points are redeemable at participating Mitre 10 or Home Hardware stores or online at Mitre10.com.au or HomeHardware.com.au. The Major Prize (including any unused portion) cannot be transferred, exchanged or redeemed for cash, unless otherwise specified. Terms and Conditions
- Information on how to enter the promotion and prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.
- All entrants acknowledge that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded a prize to the ineligible person. Return of the prize or payment of its equivalent value to the Promoter may be required by the Promoter if this occurs.
- Each entrant is responsible for ensuring his or her familiarity with these Terms and Conditions at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of that restriction or of these Terms and Conditions generally.
- Incomplete and indecipherable entries and any entry which has incorrectly entered personal information or contact details shall be deemed an invalid entry. No responsibility is accepted by the Promoter for late, lost, misdirected, ineligible or illegible/inaudible entries (including lost, stolen, forged, defaced or damaged proof of entry or things required by the Verification Requirements).
- The Promoter’s decision in relation to any aspect of these Term and Conditions and the Promotion is final and binding on every person who enters. No correspondence will be entered into.
- The Promoter may, in its sole discretion, declare any or all entries made by an entrant invalid, and/or prohibit further participation by an entrant in this Promotion or a prize event/activity if the entrant:
- disrupts, annoys, abuses, threatens, harasses or attempts to do any of these things to the
Promoter, another entrant or potential entrant of, or anyone else associated with, this Promotion.
- submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process; or
- engages in conduct in relation to this Promotion, which is misleading, deceptive, fraudulent or damaging to the Promoter's goodwill or reputation.
- If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to modify, suspend, terminate or cancel the promotion, as appropriate subject to state/territory regulation approvals.
- Entries must be received by the Promoter and will be deemed to have been received at the time of receipt by the Promoter. Online and other electronic entries are deemed to have been received at the time of receipt into the promotion database and not at the time of transmission by the entrant.
- Any costs associated with accessing the Promotion website are the entrant’s responsibility and are dependent on the internet service provider used. Entrants must submit their entries and/or claims manually using an internet browser.

- The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, communication network, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise, injury or damage to entries or to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in this Promotion. If the Promotion is not capable of being conducted due to circumstances beyond the Promoter's control, including due to any technical or communications problems, the Promoter reserves the right to amend, suspend or cancel the competition subject to approval from any relevant authority.
- Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
- As a condition of claiming a prize, the winners may be required to (at the Promoter’s discretion) sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
- The Promoter may communicate or advertise this promotion using Facebook and/or Instagram or another social media platform. However, the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other social media platform. Entrants are providing their information to the Promoter and not to Facebook or Instagram. Each entrant completely releases Facebook and Instagram from any and all liability in connection with this Promotion.
- The prize(s) and/or parts of the prize(s) is/are not transferable or exchangeable and cannot be taken as cash (unless the prize is cash). If a prize, or an element of a prize, is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that prize, or element of it, subject to the approval of any relevant authority. The Promoter and its representatives will not be liable for any damage to or delay in transit of prizes.
- The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means as invalid.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
- The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable
Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Entrants irrevocably consent and assign to the Promoter all intellectual property including copyright in the images submitted by them during this competition. Entrants also irrevocably consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties required for the provision of the Promotion and prizes. Entry is conditional on providing this information. The Promoter may disclose the information for those purposes to its related bodies corporate and contractors. If entrants do not provide the information requested, they will not be able to enter the Promotion.
- In addition to the privacy term set out above, if the entrant has ticked the "opt-in" box, the Promoter may also use personal information entrants provide to send information about the Promoters products and services (including via electronic means), and may disclose the information to its related bodies corporate, agencies, third parties and contractors (including call centres, advertising agencies and direct mail houses) the Promoter engages for that purpose.
- Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to refer the matter to law enforcement authorities and/or to seek damages or such other civil remedies as the Promoter may determine from time to time to the fullest extent permitted by law.
- The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at https://www.mitre10.com.au/legal/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. The Privacy Policy also contains information about how the Eligible Entrant may opt out, access, update or correct their PI, how the Eligible Entrant may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose the Eligible Entrant PI to any entity outside of Australia.
The Promoter may also disclose PI to our Promotional Partners, if an Eligible Entrant consents to such disclosure during the Promotion, who may use the information for their own marketing purposes. WAIVER, RELEASE & CONSENT FORM

Any person participating in the below-specified activity (“Activity”) organized by MITRE 10 AUSTRALIA PTY LTD ACN 009 713 704 and the Mitre 10 store hosting this event (collectively “MITRE 10”) is, by signing this form, waiving and releasing to the extent permitted by law any and all claims against MITRE 10 and other parties as detailed below, which claims arise from or in connection with the Activity.

In consideration of MITRE 10 allowing me to participate in the Activity (as detailed above), I, the undersigned hereby acknowledge and agree with MITRE 10 as follows:
Risk Warning and Acknowledgment
- I acknowledge and agree that the Activity involves physical activity, and there are risks associated with participation in the Activity. Accidents may and do happen, which could result in serious personal injury to myself or others and/or damage to my property or others’. While measures may be taken by MITRE 10 to reduce such risks, there will always remain a certain level of risk. Prior to undertaking the Activity, I have considered all of the possible risks involved and accept them voluntarily.
- I acknowledge and agree with MITRE 10 that, if I am suffering from any medical or health condition, my participation in the Activity might be associated with increased or additional risks. I represent and warrant that I do not suffer from any such medical or health condition or have sought and followed appropriate medical advice before participating in the Activity.
- I acknowledge that MITRE 10 may not have accident, medical, liability or other insurance coverage for participants of the Activity including myself. I agree to pay all costs resulting from such treatment for myself.
Waiver and Indemnity
- To the fullest extent permitted by law, I acknowledge and accept that MITRE 10 makes no representation, warranty or other assurances in respect of the Activity including the adequacy of any safety measures taken by MITRE 10.
- I knowingly and freely assume full responsibility for participating in the Activity, including responsibility for any and all of the risks associated with my participation in the Activity, both known and unknown, unless the same is directly caused by the gross negligence or willful misconduct of MITRE 10 and/or its employees, officers, or agents. I acknowledge that such risks include (without limitation) death, personal injury and property damage pertaining to myself or others, whether caused by MITRE 10 and/or its employees, officers, contractors, agents or other persons.
- I agree with MITRE 10 to comply with the conditions for participation of the Activity including any safety measures or directions prescribed by MITRE 10 in relation to myself or the care of other participants. I agree to avoid any willful misconduct, recklessness, negligence or failure to comply such conditions on my part when participating in the Activity, as I am aware that such behavior may result in death, personal injury or property damage pertaining to myself or others. If I observe any hazard during my presence or participation, I will remove myself from participation and bring such hazard to the attention of the nearest MITRE 10 employee, officer or agent.
- I, intending to legally bind myself, my heirs, executors and administrators, hereby waive and release MITRE 10, its affiliated companies, and their past and present officers, directors, agents, employees, representatives, successors and assigns and any person or entity acting for or on behalf of them (the “Releasees”) from any and all rights and claims for injuries and damages that may be suffered by me in connection with my participation on the Activity. I agree to fully indemnify the Releasees and hold them harmless from and against any and all losses, claims, liabilities and/or expenses arising from or otherwise connected with my breach of the terms herein.
Usage Picture Taking for Commercial Purpose
- I agree to allow MITRE 10 to take, edit and use any still images (photographs), moving images (video recordings) or sound recordings of me (with or without mention of my name) for the purpose of promotion of the MITRE 10 brand by all media, without any fee or obligation to me. MITRE 10 shall be the legal and beneficial owner of the copyright in all such pictures. If required, I will promptly transfer and assign to MITRE 10 all of my rights in and to such images and recordings.
Governing Law and Jurisdiction
- The terms in this form will be governed by and construed in accordance with the laws of Victoria, Australia. I agree to exclusively submit any claim or dispute arising under or connected with the terms of this form and/or the Activity to the jurisdiction of the courts of Victoria, Australia.
